These terms of use set out the rules under which you use the services provided by TaleInTune.com. By placing an order, you agree to these terms.

2. Services provided

TaleInTune.com provides personalised song creation services. The service comprises:

• Creating a unique song on the basis of the information provided by the customer
• Adapting the song to the mood and style chosen by the customer
• A free 90-second preview of the created song before payment
• Delivery of the final product in digital form (an audio file); further digital products relating to the song may be purchased for an additional fee, as set out in clause 4
• Free revisions of the song, with no fixed number, via the personal link sent together with the song
• The song - its lyrics, melody and vocals - is created using artificial intelligence tools on the basis of the information provided by the customer in the order form. The vocals are not recorded by performers in a studio. Every work is unique, and the fulfilment of orders and the final result are overseen by the service provider.

3. Placing an order

An order is deemed confirmed when:

• The customer completes the order form on the website
• The customer pays for the service through the Stripe payment system
• The customer receives confirmation of the order by email

By placing an order, the customer confirms that all the information provided in the order form is correct and complete.

4. Price and payment

Price of the service

The price of the service is stated on the order page before payment and depends on the selected market, currency and delivery package (standard or express delivery). The price shown is final and includes all taxes. In addition to the song, the customer may purchase, at checkout or immediately after payment, the following digital products: a printable QR song card (PDF and PNG files); a second version of the song (the same lyrics in a different rendition); an extra personalised verse, by which the delivered song is extended; an instrumental (karaoke) version of the song; and a photo music video assembled from photographs supplied by the customer. All of these are digital products delivered by email or on the song page, and nothing is shipped physically. The price of each of them is likewise stated before payment.

Payment methods

Payments are accepted through the Stripe payment system. The available payment methods are: bank cards (Visa, Mastercard), Apple Pay, Google Pay and other methods supported by Stripe.

Payment procedure

Payment is made in advance, before creation of the song begins. An order is put into production only once confirmation of successful payment has been received.

5. Provision of the service and delivery

Delivery time

The personalised song is delivered within up to 2 days of payment, or from 30 minutes where express delivery has been selected. In most cases the song is ready sooner; in the rare event of a delay, we will inform you by email. These time limits apply to the song. Digital products purchased in addition are delivered by email or on the song page, and the photo music video is delivered within up to 3 working days.

Method of delivery

The finished song is delivered by email as a high-quality audio file (in MP3 or WAV format).

Preview and revisions

Together with the song you receive a personal revisions link, where you may request free revisions - changing the lyrics, the musical style or the vocals. The first three revisions are requested via the personal link, one at a time; after that, simply email your order number to info@taleintune.com and we keep revising free of charge until you are satisfied.

6. Refund policy

Right of withdrawal (14 days)

A consumer generally has the right to withdraw from a distance contract within 14 days without giving any reason. For digital content which is not supplied on a tangible medium, the exception laid down in law applies: this right is lost where performance of the service has begun before the expiry of the 14-day period, with the consumer's express prior request that it begin immediately and the consumer's acknowledgement that he thereby loses the right of withdrawal.

At the time of payment you expressly request that creation of the song begin immediately and confirm that you understand that, from the moment creation begins, you lose the 14-day right of withdrawal. Before paying, you listen free of charge to 90 seconds of your song, so you know in advance what you are buying. Once creation of the song has begun, no refunds are given - instead, you receive free revisions with no fixed number, until you are satisfied. If creation has not yet begun, you may withdraw by writing to info@taleintune.com.

This does not limit your rights where the service has been supplied improperly or does not correspond to its description - in such cases the usual consumer remedies apply.

Instead of refunds we offer revisions - they work as follows:

• ✓ Free revisions with no fixed number via the personal link which you receive together with the song
• ✓ The song's lyrics, musical style or vocals may be revised
• ✓ If you need more changes, email your order number to info@taleintune.com - we will keep tuning the song until it feels right

We recommend completing the order form in as much detail as possible, so that the song created matches your expectations as closely as possible.

Money may be refunded only where we are unable to provide the service for technical reasons or where the payment was made in error. In such cases contact us by email at info@taleintune.com.

7. The customer's responsibilities

The customer undertakes:

• To provide correct and complete information in the order form
• To respond in good time to our requests for additional information
• To express clearly any wishes and comments concerning the creation of the song
• Not to provide information which would infringe the rights of third parties
• Not to use the song for commercial purposes without our consent

8. Intellectual property rights

The customer's rights

Upon payment in full, the customer acquires a non-exclusive right to use the created song for personal purposes - as a gift, at family celebrations, on social networks (for non-commercial purposes).

Copyright

Copyright in the song remains with the service provider. The customer may not sell, distribute or otherwise use the song for commercial purposes without written consent.

Portfolio use

We reserve the right to use the songs created in our portfolio, marketing materials and examples, unless the customer expressly asks us not to do so.

9. Limitation of liability

TaleInTune.com is not liable for:

• The accuracy or completeness of the information provided by the customer
• The song's correspondence to the customer's expectations where incomplete information has been provided
• Technical disruptions beyond the service provider's control
• The operation of third-party services (e.g. Stripe, email providers)
• Indirect losses or lost profit

Our maximum liability is limited to the price paid for the service.

10. Protection of personal data

When processing your personal data, we act in accordance with our Privacy Policy , which complies with the requirements of the GDPR and of the legislation of the Republic of Lithuania.

12. Dispute resolution

Any disagreements shall be settled by negotiation. If no agreement is reached, disputes shall be resolved in accordance with the procedure laid down by the laws of the Republic of Lithuania.

The customer may also apply to the State Consumer Rights Protection Authority ( www.vvtat.lt ) or to the European Consumer Centre in Lithuania ( www.ecc.lt ).

13. Changes to the terms

We reserve the right to amend these terms at any time. We will inform you of material changes by email or on the website. By continuing to use the service after such changes, you agree to the updated terms.

14. Final provisions

These terms are governed by the laws of the Republic of Lithuania.

If any part of these terms is held to be invalid, the remaining terms shall remain in force.

Our commitment

TaleInTune.com undertakes to provide high-quality personalised song creation services: you hear 90 seconds of your song before you even pay, and once you have received the full song you may request free revisions until the song feels right, with no fixed number. Your gift will be unique - no one else has a song like it.
